FIREPOV LLC PRESENTS PICTURES OF AND AUDIOVISUAL WORKS DEPICTING NUDE FEMALES AND MALES ENGAGING IN SEXUAL ACTIVITIES. YOU UNDERSTAND THAT BY USING THIS SERVICE, AND BY MERELY ACCESSING THIS WEBSITE, YOU MAY BE EXPOSED TO CONTENT THAT IS OFFENSIVE, INDECENT, OR OBJECTIONABLE.

THE MATERIAL ON THIS WEBSITE/SERVER IS ADULT ORIENTED AND/OR SEXUALLY EXPLICIT AND IS RELATED TO MATERIAL OF AN ADULT NATURE. Subscription, End User License Agreement & Terms of Service

This Subscription, End User License Agreement & Terms of Service (the "Subscription Agreement") is a binding contract between you, an individual user ("you") and FIREPOV LLC ("FIREPOV"), governing your use of the Website and Service. BY ACCESSING THE WEBSITE AND/OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS SUBSCRIPTION AGREEMENT. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS OR USE THE SERVICE. CONTACT FIREPOV AT contact@firepov.com IF YOU WANT FIREPOV TO SEND YOU A COPY OF THIS SUBSCRIPTION AGREEMENT AND FIREPOV'S PRIVACY POLICY.

Material Terms:

As provided in greater detail in this Subscription Agreement, you acknowledge the following:

  • The Service is licensed, not sold to you, and that you may use the Service only as set forth in this Subscription Agreement;
  • The use of the Service may be subject to separate third-party terms of service and fees;
  • The WebSite and Service presents pictures of nude males and females and audiovisual works depicting sexual activities;
  • FIREPOV is not a talent agent and is not licensed under the Labor Code of the State of California;
  • All proper model releases and age verification are maintained as required by 18 U.S.C. §2257;
  • You agree not to reproduce, duplicate, copy, sell, distribute, rent, resell or exploit any portion of the Service;
  • You consent to the collection, use, and disclosure of your personally identifiable information in accordance with FIREPOV's Privacy Policy;
  • The Service is provided "as is" without warranties of any kind;
  • Subscription to the Service is on an auto-renewal program;
  • Some disputes arising hereunder will be resolved by binding arbitration.

Scope of License

The Service is licensed, not sold, to you for use only under the terms of this Subscription Agreement. FIREPOV reserves all rights not expressly granted to you. Subject to your complete and ongoing compliance with the terms and conditions of this Subscription Agreement, FIREPOV hereby grants you a personal, limited, revocable, non-transferable license to use the Service on a single compatible device that you own or control, solely for your own private, personal, non-commercial use.

You may not make the Service available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, redistribute or sublicense the Service. You may not attempt to derive the source code of, modify, or create derivative works of the Service.

The Website and Service

A. Description of Services

The "Service(s)" means, collectively, FIREPOV's: (a) audiovisual service offering access to a selection of audiovisual works and other content, whether available through our website located at firepov.com or through any software applications made available for mobile devices; (b) all software, data, text, images, sounds, video, graphics and photos made available by FIREPOV; and (c) any updates, new versions, and additional features.

B. Consideration

You understand and agree that this Subscription Agreement is entered into in consideration of your payment of the Subscription Fee for your access to and use of the Service. Any end user who accesses the public-facing portions of the Service will be referred to as a "Visitor," and any end user who registers for a Subscription will be referred to as a "Subscriber".

C. Changes to the Service

FIREPOV may at its sole discretion change, add or remove features and functionality of the Service. FIREPOV reserves the right to discontinue some or all of the features of the Service at any time. If you are dissatisfied with any changes to the Service, then your sole option is to discontinue or terminate your use of the Service.

D. Privacy Policy

Your use of the Service is subject to the Privacy Policy, which is hereby incorporated by reference into this Subscription Agreement.

Registration and Eligibility

A. Account

To access certain features and functionality of the Service, you must register an account with FIREPOV. You are responsible for maintaining the confidentiality of your log-in credentials and are fully responsible for all activities that occur through the use of your credentials.

B. Accuracy of Information

You agree to provide true, accurate, current, and complete information about yourself and to update the information promptly to keep it current and accurate.

C. Subscriptions

You may sign up for a trial period, monthly, bi-monthly, quarterly or annual paid Subscription to the Service at any time.

D. Children

The Service is not intended for children. IF YOU ARE UNDER 18 YEARS OF AGE, THEN YOU MUST NOT USE OR ACCESS THE SERVICE AT ANY TIME OR IN ANY MANNER. You must be at least the age of majority in your jurisdiction to use the Service.

Fees and Payment Terms

IF YOU ARE A SUBSCRIBER, THEN YOU AGREE TO PAY THE SUBSCRIPTION FEE ON A TIMELY BASIS.

Payment Terms:

  1. By using the service, you acknowledge that you have read and agree to be bound by these payment terms.
  2. We accept various forms of payment. We do not accept cash or checks.
  3. By providing your payment method, you authorize our payment processor to charge the applicable subscription fees and taxes.
  4. Unless you notify us of your decision to terminate, your subscription will automatically renew.
  5. Your payment method will be charged on your billing date based on the type of subscription.
  6. If you fail to pay when due, your account may be downgraded, suspended or canceled.
  7. You may cancel your subscription at any time. To cancel, please contact us at contact@firepov.com.
  8. We reserve the right to change subscription fees with at least thirty (30) days notice.
  9. Monthly Free Trials auto renew and can be canceled at anytime.

Advertisements

A. Third Party Advertisements

FIREPOV may display advertisements for third parties on the Service. Your dealings with third-party advertisers are solely between you and such third party. FIREPOV is not responsible or liable for any loss or damage incurred as a result of any such dealings.

B. Third Party Sites

The Service may include links to third party websites or services ("Third-Party Sites"). FIREPOV does not endorse or represent such third parties and is not responsible for their availability or content.

Special Notice For International User; Export Controls

Software available in connection with the Service is subject to United States export controls. No software may be downloaded or exported in violation of U.S. export laws. You agree to comply with all local rules and laws regarding your use of the Service. FIREPOV makes no representation that the Service is appropriate or available for use in any particular location.

Content You Submit; License Grants From You

A. User Content

This Section governs any material that you post, send or transmit through the Service ("User Content"). You are solely responsible for securing the rights to any and all User Content you Post to or through the Service.

B. License Grant

BY POSTING USER CONTENT TO THE SERVICE, YOU GRANT TO FIREPOV AN UNRESTRICTED, PERPETUAL, ASSIGNABLE, SUBLICENSABLE, REVOCABLE, ROYALTY-FREE LICENSE TO REPRODUCE, MODIFY, DISTRIBUTE, DISPLAY, PUBLISH, TRANSMIT, AND OTHERWISE USE ALL USER CONTENT YOU POST.

C. Representations and Warranties

You represent and warrant that you either are the sole owner of all of your User Content, or you have all rights necessary to grant to FIREPOV the rights in your User Content as contemplated under this Agreement.

Use Restrictions

Your rights to use the Service are expressly conditioned on the following:

  • You may access the Service for your personal entertainment purposes only.
  • You may not copy, distribute, re-sell, alter, modify, or create derivative works of the Service.
  • You agree not to bypass or interfere with any security features of the Service.
  • You agree not to reverse engineer, decompile, or disassemble any aspect of the Service.
  • You agree not to harass, abuse, or harm others.
  • You agree not to provide false personal information.
  • You agree not to impersonate another person or entity.
  • You agree not to use the Service for commercial purposes without express written consent.
  • You agree not to Post content that is defamatory, unlawful, harmful, threatening, or obscene.
  • You agree not to violate any applicable laws through the use of the Service.

ANY AND ALL VIOLATIONS CAN AND WILL BE MET WITH LITIGATION INSTITUTED AGAINST YOU.

Security

You understand that the operation of the Service may be unencrypted and involve transmissions over various networks and changes to conform to technical requirements. FIREPOV will have no liability to you for any unauthorized access or use of your Subscription, or any corruption, deletion, destruction or loss of Content.

Ownership

The Service, Content, and all intellectual property rights therein, is the sole and exclusive property of FIREPOV and its licensors. Except for the limited license expressly granted to you under this Agreement, no other rights or licenses are granted.

Feedback

If you send FIREPOV any ideas, suggestions, or feedback (collectively "Feedback"), then the following terms apply:

  • FIREPOV has no obligation to review, consider, or implement your Feedback.
  • Feedback is provided on a non-confidential basis.
  • You grant FIREPOV perpetual permission to use the Feedback for any purpose without restriction, free of charge and without attribution.

Termination

This Subscription Agreement is effective until terminated by you or FIREPOV.

A. Automatic Termination

Your rights under this Agreement will terminate automatically without notice from FIREPOV if you fail to comply with any term(s) of this Agreement.

B. Termination by You

You may terminate your account at any time by contacting FIREPOV Customer Support at contact@firepov.com.

C. Termination by FIREPOV

FIREPOV has the right to immediately disable, suspend, or terminate your account at any time for any reason or no reason, with or without notice to you.

Indemnity

You agree to indemnify and hold FIREPOV, and its officers, directors, employees, agents, successors, and assigns harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected to (a) your access, use, or misuse of the Service; (b) your User Content; or (c) your violation of this Agreement.

No Warranty

USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ANY CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

FIREPOV HEREBY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SERVICE, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT WILL FIREPOV BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE.

IN NO EVENT WILL FIREPOV'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO FIREPOV IN THE PRECEDING 12 MONTHS; OR (B) ONE HUNDRED DOLLARS ($100.00).

Third Party Disputes

FIREPOV IS NOT AFFILIATED WITH ANY THIRD PARTY SERVICE PROVIDER, AND ANY DISPUTE YOU HAVE WITH ANY SUCH THIRD PARTY IS DIRECTLY BETWEEN YOU AND SUCH THIRD PARTY, AND YOU IRREVOCABLY RELEASE FIREPOV FROM ANY AND ALL CLAIMS ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.

Dispute Resolution

Mandatory Arbitration

YOU AND FIREPOV AGREE TO ARBITRATION AS THE EXCLUSIVE FORM OF DISPUTE RESOLUTION FOR ALL DISPUTES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE. Arbitration is more informal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury.

No Class Actions

YOU AND FIREPOV AGREE THAT YOU MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

The arbitration will be administered by the American Arbitration Association ("AAA"). For more information, visit www.adr.org.

Arbitration Waiver

Both parties hereby agree to waive all provisions for mediation and arbitration in regard to claims for the infringement of intellectual property. Any such claims shall be resolved by a court of competent jurisdiction in Los Angeles County, California. THIS PARAGRAPH SHALL SUPERSEDE THE ARBITRATION PROVISION AS IT APPLIES TO CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT.

Governing Law

The laws of the State of California, excluding its conflicts of law rules, govern your use of the Service. To the extent that any action relating to any dispute hereunder is permitted to be brought in a court of law, such action will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

PLEASE NOTE THAT BY AGREEING TO THIS AGREEMENT, YOU ARE WAIVING CLAIMS THAT YOU MIGHT OTHERWISE HAVE AGAINST US BASED ON THE LAWS OF OTHER JURISDICTIONS.

Recovery of Expenses

In any proceedings between the parties arising out of or relating to claims of intellectual property infringement, the prevailing party will be entitled to recover from the other party all expenses that the prevailing party incurs, including legal fees and expenses.

Jury Trial Waiver

Each party hereby waives its right to a trial by jury in any claims arising out of or relating to the subject matter of this agreement. Either party may enforce this waiver up to and including the first day of trial.

Assignment

You may not assign this Agreement without the prior written consent of FIREPOV. FIREPOV may assign this Agreement, including all its rights hereunder, without restriction. Any assignment in violation of this Section is void.

Survival

The provisions of this Agreement that are intended to survive the termination by their nature will survive, including but not limited to sections regarding Fees and Payment Terms, Content You Submit, Use Restrictions, Security, Ownership, Feedback, Termination, Indemnity, No Warranty, Limitation of Liability, and Dispute Resolution.

Consent to Electronic Communications

By electronically signing this agreement, you affirmatively consent to receiving communications from us including the service of all legal documents, through the email address provided to FIREPOV. You agree that any notices sent to you electronically will satisfy any legal communication requirements. BY SIGNING THIS AGREEMENT, YOU ARE HEREBY WAIVING ANY LEGAL RIGHT TO CLAIM THAT PERSONAL SERVICE WAS INEFFECTIVE.

Miscellaneous

This Subscription Agreement, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire and exclusive understanding and agreement between you and FIREPOV regarding your use of and access to the Service.

The failure to require performance of any provision will not affect our right to require performance at any time thereafter. In the event that any part of this Agreement is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible and the remaining parts will remain in full force and effect.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and FIREPOV as a result of this Agreement or use of the Service.

FIREPOV LLC has a strict zero-tolerance policy regarding human trafficking, coercion, and exploitation of any kind. We are committed to ensuring that all content on our platform is produced with the full, informed, and voluntary consent of all individuals depicted. Any content found to involve human trafficking, coercion, or exploitation will be immediately removed, and appropriate authorities will be notified.

Legal Compliance

FIREPOV complies with all applicable federal and state laws related to human trafficking prevention, including:

  • Trafficking Victims Protection Act (TVPA)
  • Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA)
  • Stop Enabling Sex Traffickers Act (SESTA)
  • 18 U.S.C. § 2257 - Age verification and record-keeping requirements
  • State-specific trafficking prevention laws

Prevention Measures

To prevent human trafficking and exploitation, FIREPOV implements the following measures:
